User Agreement of Individual Entrepreneur “OSMAR CONSULTING”

This User Agreement (hereinafter referred to as the “Agreement”) governs the use of the website https://osmar.kz/ (hereinafter referred to as the “Website”) and sets out the rights and obligations of users of the Website of Individual Entrepreneur “OSMAR CONSULTING” (hereinafter referred to as the “Website Owner”).

1.General Provisions

1.1.The Website is an information resource intended to provide information about the activities and legal services of the Website Owner, to provide information to users, and to enable users to submit enquiries and applications.

1.2.Use of the Website constitutes the User’s acknowledgement of and agreement with this Agreement and its terms. If the User does not agree with the terms of this Agreement, the User must cease using the Website.

1.3.Information about services published on the Website does not constitute a public offer unless expressly stated otherwise. The terms and conditions for the provision of specific legal services shall be determined by a separate agreement entered into between the User and the Website Owner.

2.Rights and Obligations of the User

2.1.The User shall have the right to:

2.1.1.use the functionality of the Website;

2.1.2.obtain information about the activities and services of the Website Owner;

2.1.3.submit enquiries and applications through the feedback forms and communication channels specified on the Website.

2.2.The User shall:

2.2.1.provide accurate and up-to-date information when submitting enquiries and applications;

2.2.2.use the Website solely for lawful purposes;

2.2.3.refrain from interfering with the operation or security of the Website;

2.2.4.refrain from gaining unauthorised access to the Website or its restricted sections;

2.2.5.refrain from using automated means to collect or copy information from the Website on a mass scale without the consent of the Website Owner;

2.2.6.refrain from infringing the intellectual property rights of the Website Owner or third parties.

3.Rights of the Website Owner

3.1.The Website Owner shall have the right to modify the content, structure and functionality of the Website, amend, remove or supplement published materials, temporarily suspend the operation of the Website for the purpose of carrying out technical maintenance, and restrict access to the Website where the User breaches this Agreement or the legislation of the Republic of Kazakhstan.

4.Information on Legal Services

4.1.The information published on the Website, including articles, publications, reviews, answers to questions and other materials, is provided for informational purposes only.

4.2.Such information does not constitute individual legal advice or a legal opinion and does not guarantee any particular outcome in relation to a specific matter.

4.3.The possibility of and terms and conditions for providing legal assistance shall be determined taking into account the circumstances of the specific matter and the agreement entered into between the parties.

5.Intellectual Property

5.1.The texts, images, logos, designs and other materials published on the Website constitute intellectual property of the Website Owner and/or other rights holders.

5.2.Copying, distribution, publication, adaptation or any other use of the materials published on the Website without the prior consent of the relevant rights holder is not permitted, except in cases provided for by the legislation of the Republic of Kazakhstan.

6.Personal Data

6.1.The processing of the User’s personal data shall be carried out in accordance with the legislation of the Republic of Kazakhstan and the Policy on the Collection, Processing and Protection of Personal Data published on the Website.

6.2.When submitting an enquiry or application, the User shall provide accurate information and, where required by law, provide the necessary consents to the processing of personal data.

7.Liability

7.1.The Website Owner shall take reasonable measures to ensure the proper operation of the Website; however, the Website Owner does not guarantee that the Website will be free from technical errors or interruptions.

7.2.The Website Owner shall not be liable for the temporary unavailability of the Website, failures or disruptions in communication networks or third-party services, or for the content of third-party internet resources to which links may be provided on the Website.

7.3.The Website Owner shall not be liable for decisions made independently by the User on the basis of information published on the Website without obtaining individual legal advice.

7.4.The liability of the parties shall be determined in accordance with the legislation of the Republic of Kazakhstan.

8.Amendments to the Agreement

8.1.The Website Owner shall have the right to amend this Agreement unilaterally. The new version shall enter into force upon its publication on the Website, unless a different effective date is specified in the new version.

8.2.Continued use of the Website after the publication of a new version of the Agreement shall constitute the User’s acceptance of its terms.
